These Terms of Use ("Terms", "Agreement"), including any policies and procedures incorporated by reference (including our Privacy Policy, Return and Refund Policy and Billing Terms), constitute a legal agreement between the User ("you", "your" or "user") and Vista Labs LLC ("we", "us", "our", "The Astroverse", "the Company"), a company registered in England and Wales with the address 1309 Coffeen Ave STE 1200, Sheridan, WY 82801, USA.

These Terms govern your access to and use of our website, web application and all related services, features and content offered by the Company (collectively, the "Service").

By using the Service, you agree to be bound by these Terms. Please read them carefully. IF YOU DO NOT ACCEPT THESE TERMS, YOU MAY NOT USE THE SERVICE.

CHANGES AND MODIFICATIONS

We reserve the right to change the Service and these Terms at any time. Material changes will be communicated via the Service or by email. Your continued use of the Service after the effective date constitutes your acceptance of the modified terms. If you disagree with the changes, you must stop using the Service.

THE SERVICE

As long as you comply with this Agreement, we grant you a personal, non-transferable, non-exclusive, revocable right to access and use the Service for its intended purpose and in accordance with these Terms and applicable law.

The Service is provided solely for entertainment purposes. It does not constitute psychological, medical, financial or other professional advice. The Astroverse and any affiliated psychics or content providers are not licensed healthcare professionals or professional advisors. Information, horoscopes, analyses and chat sessions with psychics are intended as inspiration and entertainment and should not replace professional advice. Always seek the advice of qualified professionals if you need personal, medical, psychological or financial assistance.

You acknowledge that any decision made on the basis of information from the Service is made at your own risk. We assume no responsibility for the accuracy, reliability or usefulness of the content provided through the Service, including information from chats with psychics.

AGE REQUIREMENT

You must be at least 18 years old to use the Service. By using the Service, you confirm that you meet this age requirement.

PERMITTED AND PROHIBITED USE

You may only use the Service for personal, non-commercial entertainment purposes.

You may not:

• Sell, rent, lease, distribute or otherwise transfer rights to the Service.
• Copy, modify, translate or create derivative works of the Service without written permission.
• Circumvent technical protection measures in the Service.
• Use the Service for illegal purposes or to infringe the rights of others.
• Upload content that is hateful, abusive, obscene, pornographic or otherwise illegal or in violation of these Terms.
• Upload viruses or other harmful code.
• Attempt to gain unauthorized access to the Service or other users' accounts.
• Use automated systems (robots, spiders, etc.) to access the Service unless provided by us.
• Place an unreasonable load on our infrastructure.
• Use the Service to develop a competing product or copy our design/content.
• Misuse the chat feature, e.g. by harassing psychics or other users.

Violation of these rules may result in the immediate termination of your right to use the Service.

INTELLECTUAL PROPERTY

All content in the Service, including text, graphics, logos, images, software, PDF files, horoscopes and design ("Our Content"), is owned by or licensed to Vista Labs LLC and is protected by copyright and other intellectual property rights. You may not copy, distribute, modify or otherwise use Our Content without express permission.

SUBSCRIPTIONS, ONE-TIME PURCHASES AND CREDITS

We offer different ways to access our content and services, including:

• Automatically renewing subscriptions (monthly).
• One-time purchases of digital content (e.g. PDF horoscopes).
• Purchases of credits for use in chats with psychics.

Details about pricing (incl. tax), payment, trial periods and cancellation can be found in our Billing Terms. Terms for refunds can be found in our Return and Refund Policy.

You are responsible for managing your subscription and your purchases. Cancellation of a subscription must be done in accordance with the Billing Terms to avoid future charges.

THIRD-PARTY LINKS

The Service may contain links to third-party websites. We have no control over and are not responsible for the content or practices of these websites. Your use of third-party websites is at your own risk.

TERMINATION

We may terminate or suspend your access to the Service without notice if you violate these Terms. You may stop using the Service at any time and request deletion of your account by contacting us.

DISCLAIMER

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT THE INFORMATION (INCLUDING HOROSCOPES AND CHAT SESSIONS) IS ACCURATE, RELIABLE OR SUITABLE FOR YOUR NEEDS. USE OF THE SERVICE IS AT YOUR OWN RISK.

THE SERVICE IS FOR ENTERTAINMENT ONLY AND DOES NOT CONSTITUTE PROFESSIONAL ADVICE.

LIMITATION OF LIABILITY

TO THE EXTENT PERMITTED BY LAW, Vista Labs LLC OR ITS AFFILIATES, DIRECTORS, EMPLOYEES OR AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS IN CONNECTION WITH THE SERVICE WILL NOT EXCEED THE AMOUNT YOU HAVE PAID US FOR USE OF THE SERVICE IN THE SIX (6) MONTHS PRIOR TO THE CLAIM.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including mandatory rules of Danish consumer law.

INDEMNIFICATION

You agree to defend, indemnify and hold Vista Labs LLC and its affiliated parties harmless from any claim or liability (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the Service.

GOVERNING LAW AND JURISDICTION

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict-of-law rules.

Any disputes arising in connection with these Terms or your use of the Service shall be sought resolved amicably. If an amicable resolution cannot be reached, you acknowledge that the English courts have non-exclusive jurisdiction. However, this does not affect your rights under mandatory Danish consumer law, including the right to bring an action before the Danish courts.

GENERAL PROVISIONS

• Severability: If a provision of these Terms is found to be invalid, that provision shall be modified to the extent necessary to make it valid, and the remaining provisions shall remain in effect.
• No Waiver: Our failure to enforce a right or provision of these Terms does not constitute a waiver of that right or provision.
• Assignment: We may assign our rights and obligations under these Terms. You may not assign your rights or obligations without our written consent.
• Electronic Communication: You agree to receive communications from us electronically (e.g. by email or the Service). Electronic communication has the same legal validity as written communication.
• Entire Agreement: These Terms, together with the incorporated policies (Privacy Policy, Return and Refund Policy, Billing Terms), constitute the entire agreement between you and Vista Labs LLC regarding the Service.
